Court Applies Rule of Harmonious Construction to Resolve Ambiguity in Statutory Provisions Related to Election of Municipal President
In a significant ruling, the Madhya Pradesh High Court, Gwalior Bench, has set aside an earlier order dismissing an election petition (EP) filed by Sumer Singh, challenging the election of Smt. Renu Garg as President of the Municipal Council, Sheopur. The court deemed the petition maintainable despite the absence of a Gazette notification announcing the President's election, invoking the rule of harmonious construction to resolve statutory ambiguities.
The case, presided over by Justice Ashish Shroti, revolved around the maintainability of the EP filed by Singh, who contested the election results on various grounds. The EP was initially dismissed by the First District Judge, Sheopur, citing premature filing due to the absence of a Gazette notification as required under the M.P. Municipalities Act, 1961.
Justice Shroti highlighted the legislative amendments made in 2020, which shifted the election of the President from a direct public vote to an indirect election by elected Councillors. This change led to an inconsistency between the requirement of Gazette notification and the timeline for filing an EP, as outlined in Sections 20(3) and 45 of the Act.
The High Court addressed this statutory discrepancy by applying the principle of harmonious construction, asserting that the cause of action for filing the EP arises from the date of the President's election in the first meeting of the Council, rather than waiting for a Gazette notification. Consequently, the court found the EP filed by Singh within 30 days of the President's election to be timely and valid.
Furthermore, the court criticized the conduct of non-applicant No. 1, Smt. Renu Garg, for raising objections despite being aware of the absence of a Gazette notification, labeling it as a misuse of judicial process. As a result, the court imposed a cost of Rs. 1,00,000 on Garg, half of which is to be paid to the applicant and the other half to the District Legal Services Authority, Sheopur.
The court directed the Tribunal to expedite the hearing of the EP and conclude proceedings by the end of November 2026. The ruling underscores the judiciary's role in ensuring justice and maintaining the integrity of legal processes, particularly in the domain of electoral disputes.
