Madhya Pradesh High Court Upholds Execution of Eviction Decree Against Tenant

Court affirms possession warrant issuance; tenant's failure to pay rent for five consecutive months deemed violation of compromise decree.


In a significant ruling, the Madhya Pradesh High Court has upheld the execution of an eviction decree against Smt. Suman Soni, the petitioner, reinforcing the obligations outlined in a compromise decree. The court, presided over by Justice Vivek Jain in the Jabalpur bench, dismissed the petition challenging the orders of the executing court, which had issued a possession warrant against Soni.


The case stems from a compromise decree dated October 30, 2013, involving Soni’s late husband who was a tenant in a shop owned by the Rathore Sakal Panch Trust, Khandwa. The decree stipulated that the monthly rent of Rs. 800 must be paid consistently, and any default in payment for a continuous period of five months would render the eviction decree executable.


Despite the tenant's claims that the landlord refused to accept rent payments, the court found that the tenant failed to utilize alternative methods of payment such as depositing the rent with the Rent Controlling Authority or sending it via money order. The court noted that the last rent payment was made up to October 30, 2016, and subsequent payments were attempted only in September and October 2017, beyond the permissible delay, thus constituting a default as per the decree.


Justice Jain emphasized that even a bona fide attempt to pay the rent occurred only in September 2017, long after the required payment period, thereby validating the execution proceedings initiated by the landlord. The court concluded that the executing court was justified in issuing the possession warrant and that the tenant's defenses were insufficient to countermand the terms of the compromise decree.


The ruling reinforces the importance of adhering to court decrees and outlines the responsibilities of tenants to ensure compliance with agreed terms, particularly in rental agreements. The petitioner’s failure to pay rent through available legal channels, despite the landlord's refusal, was a pivotal factor in the court's decision to dismiss the petition.
