Court Highlights Systemic Gaps in Child Protection Laws, Orders Investigations into Misuse Allegations


The Madras High Court, in a significant judgment, has called for a comprehensive overhaul of the implementation mechanisms surrounding the Protection of Children from Sexual Offences (POCSO) Act. The court, while adjudicating four interconnected cases, emphasized the need for trauma-sensitive approaches and institutional introspection to better serve child welfare.


The judgment, delivered by Justice L. Victoria Gowri of the Madurai Bench, underscores the recurring issues in handling cases under the POCSO Act, including procedural insensitivity, lack of trauma-informed investigations, and inadequate counselling mechanisms. The court noted that children are often subjected to emotional confusion and psychological strain due to the current system's mechanical processes.


The court specifically addressed the misuse of POCSO provisions, highlighting allegations of coercion and manipulation in filing false complaints. It ordered preliminary investigations into such allegations to preserve the credibility of child protection laws. The judgment also directed the Bar Council of Kerala to verify the enrolment credentials of an implicated lawyer suspected of misconduct.


In a bid to prevent abuse of the legal process, the court quashed proceedings in cases where false or exaggerated allegations were identified, noting that continuing flawed prosecutions would amount to secondary victimization of children. The judgment emphasized that the welfare of the child should be the primary focus, with recommendations for awareness programs, continuous counselling, and skill development training for both victims and stakeholders.


The court mandated the formulation of "Singapen Sensitisation Workshops" to provide trauma-sensitive training for all stakeholders involved in the POCSO ecosystem. These workshops aim to enhance the understanding of child psychology and the ethical handling of child victims.


The judgment serves as a clarion call for legislative reforms and institutional coordination, highlighting the urgent need for a justice system that is not only punitive but also rehabilitative and protective of children's emotional and psychological well-being.
