Jegadeesha Pandian, argued that despite filing a complaint which led to the registration of a 'Woman missing FIR', the police had not taken effective steps to locate the missing family. Murugan alleged that his wife had developed an illicit relationship with another individual, identified as the third respondent, and left with him, taking the children along.


Presiding over the case, Justices N. Anand Venkatesh and P. Dhanabal noted that the court's primary concern lay with the welfare of the children involved. The bench acknowledged that while Bhavani, as an adult, has the autonomy to decide her personal relationships, the situation concerning the children required judicial intervention to ensure their protection and well-being.


The court ordered the police to expedite the search and produce the missing mother and children before the Judicial Magistrate. Upon their production, the Magistrate is tasked with recording Bhavani's statement and interacting with the children to understand their situation. The court emphasized that all necessary decisions regarding the children's welfare should be made in accordance with the law, and a detailed report should be submitted back to the High Court.


The judgment concluded with the disposal of the Habeas Corpus Petition, underscoring the court's commitment to safeguarding the interests of minors while respecting the personal freedoms of adults.
