Court Acknowledges Adequate Measures by Election Commission to Tackle Illicit Election Practices
In a significant judgment, the Madras High Court dismissed a writ petition filed by petitioner K.K. Ramesh seeking directives to curb illegal distribution of gifts, cash, narcotics, and other inducements during elections. The court noted that the Election Commission of India (ECI) has already put effective measures in place to address the issue.
The Division Bench, consisting of Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan, presided over the case and emphasized the comprehensive efforts by the ECI to maintain electoral integrity in Tamil Nadu. The petitioner had sought intervention to monitor the circulation of black money and other illicit inducements during the electoral process.
During the proceedings, the counsel for the Election Commission of India informed the court about the deployment of 2,169 Flying Squad Teams and 2,166 Static Surveillance Teams across key locations and check-posts in Tamil Nadu. These teams are actively engaged in inspecting vehicles and individuals to prevent the unlawful movement of cash, liquor, narcotics, and other inducements. The ECI assured the court of its commitment to stringent action against any illegal activities.
The State of Tamil Nadu, represented by the Advocate-General, confirmed its support and assistance to the ECI's efforts, further reinforcing the robustness of the mechanisms in place. Despite the petitioner's absence during the second round of calling, the court evaluated the measures reported by the ECI and the state authorities.
Concluding that the existing measures were adequate and effective, the Bench decided not to entertain the petition, thereby dismissing it. The court's decision underscores the proactive steps undertaken by electoral and state authorities to safeguard the electoral process from illicit influences.
