Madras High Court Enhances Compensation for Motor Accident Victim

Court exercises power under Order XLI Rule 33 CPC, increasing compensation to Rs. 57.98 lakh for grievous injuries sustained in a second accident.


In a significant judgment, the Madurai Bench of the Madras High Court has enhanced the compensation awarded to a motor accident victim, Kathiresan, from Rs. 33 lakh to Rs. 57.98 lakh. The court invoked its powers under Order XLI Rule 33 of the Civil Procedure Code to ensure just compensation in the absence of a cross-appeal. The judgment, delivered by Justices N. Anand Venkatesh and K.K. Ramakrishnan, dealt with the liability of the United India Insurance Co. Ltd. for injuries sustained by the claimant in a second accident involving an ambulance.


The case revolved around two successive accidents. Kathiresan, the son, initially suffered simple injuries in a car accident on December 5, 2014. While being transported for further medical treatment, the ambulance he was in met with another accident, causing severe spinal injuries leading to permanent disability. The court found that the grievous injuries were primarily due to the second accident and held the insurer of the vehicle involved in this accident responsible.


The court criticized the advocate representing the injured for failing to file a cross-appeal for enhanced compensation, terming it a dereliction of professional duty. However, recognizing the extreme hardship and disability faced by the claimant, the court exercised its discretion to enhance the compensation, ensuring that the victim received a just and equitable relief.


The enhanced compensation considers increased amounts for attendant charges, pain and suffering, loss of amenities, and future medical expenses, reflecting the court's commitment to ensuring the victim's dignity and well-being.
