Madras High Court Initiates Legal Aid for Returning Stolen Mobile Phones and Boosts Awareness on Motor Accident Compensation

Court directs streamlined processes for property return and mandates awareness campaigns for motor vehicle accident claims.


In a significant move, the Madras High Court has directed measures to assist victims of mobile phone thefts and motor vehicle accidents. The court, under Justice D. Bharatha Chakravarthy, addressed the reluctance of victims to reclaim stolen or recovered mobile phones due to procedural hurdles and costs. Recognizing the diminished value of such devices post-theft, the court instructed the Tamil Nadu State Legal Services Authority (TNSLA) to streamline the return process.


The court's order mandates the TNSLA to facilitate the return of mobile phones and similar items through a simplified process involving email requests and courier services. This initiative aims to alleviate the burden on victims who previously had to navigate cumbersome court procedures. The Secretary of the District Legal Services Authority will coordinate with investigating officers and presiding officers to ensure the rightful owners receive their property after video verification and appropriate court orders. Courier expenses will be initially covered by the Legal Services Authority, with potential reimbursement by the State of Tamil Nadu.


In a parallel directive, the court emphasized the need for increased awareness about compensation rights under the Motor Accidents Claim Tribunal. Shockingly, many dependents of deceased or injured parties were unaware of their entitlement to compensation. The court has directed investigating officers to inform victims and their families about their rights and has called for legal aid counsel to assist in filing claims. The TNSLA is urged to conduct awareness campaigns, particularly in rural and backward districts, to educate the public on their compensation rights.


These orders mark a proactive step by the judiciary in addressing procedural inefficiencies and enhancing public awareness of legal rights, potentially setting a precedent for similar initiatives across other jurisdictions.
