Court emphasizes constitutional equality, directs temples to avoid caste references in festival communications.
In a landmark decision reinforcing the constitutional principle of equality, the Madras High Court has mandated the removal of caste suffixes from names in temple invitations, emphasizing the need to avoid caste discrimination. The judgment was delivered by Justice D. Bharatha Chakravarthy on February 17, 2026, in response to a writ petition filed by N. Samaran against the Commissioner of the Hindu Religious and Charitable Endowments Department.
The court was addressing a plea that sought to prohibit the use of caste names in the invitations for the Masi Brahmotsavam 2026 at the Arulmigu Kandhasamy Thirukovil in Thiruporur. It was argued that the inclusion of caste names in such invitations perpetuates inequality and is contrary to the equality enshrined in Article 14 of the Constitution of India.
The court noted that while the temple itself does not use caste names, the inclusion of caste suffixes by Ubayatharars -those who contribute to temple festivals—remains an issue. Although the current year's invitations had already been printed and distributed, the court directed that from the next festival onward, any caste suffix included in Ubayatharars' names should be omitted.
Justice Chakravarthy highlighted the constitutional mandate to treat all individuals equally and the necessity to eradicate caste distinctions that are based solely on birth. The court asserted that government departments involved in temple management must ensure that caste is not propagated or prominently advertised in any form.
On a related matter, the court declined to frame a Standard Operating Procedure for selecting volunteers, known as Padhamthangis, who carry the idols during temple processions. The court ruled that such decisions should be left to the discretion of the temple's Executive Officers and Trustees, as micromanagement by the courts could prove counterproductive.
The judgment is seen as a significant step towards reinforcing the principles of equality and non-discrimination in religious practices, ensuring that temple festivities align with constitutional values.
Bottom Line:
Caste names should not be used in temple invitations to avoid caste discrimination, reflecting the principle of equality enshrined in Article 14 of the Constitution of India.
