Investigation transferred to CBI due to inadequate inquiry by state agencies; systemic failures highlighted


In a landmark decision, the Madras High Court has directed the Central Bureau of Investigation (CBI) to take over the probe into a large-scale scam involving the fabrication of fake No Objection Certificates (NOCs) used to obtain explosive licenses for petroleum outlets across Tamil Nadu and Pondicherry. The judgment, delivered by Chief Justice Mr. Manindra Mohan Shrivastava and Justice G. Arul Murugan, underscores serious lapses in the investigation conducted by state agencies, prompting the court to intervene to ensure a fair and credible inquiry.


The case, titled "V.B.R. Menon v. Chief Controller of Explosives Petroleum And Explosives Safety Organisation (PESO)," stems from allegations that beneficiaries, in collusion with a racket, obtained forged NOCs to secure explosive licenses for setting up petroleum retail outlets. The petitioner, acting in person, sought the cancellation of these licenses and demanded criminal actions against the parties involved.


The court was informed of an extensive operation where fake NOCs were produced using forged signatures and seals of competent authorities. Despite some actions taken, including the cancellation of licenses and registration of criminal cases, the court found the investigation insufficient, particularly concerning the role of beneficiaries who allegedly paid large sums for these forged documents.


The court emphasized the need for systemic reforms to prevent such occurrences in the future, urging the use of technology for verification processes. Furthermore, it highlighted the absence of thorough investigation into the beneficiaries' roles, despite evidence suggesting direct dealings with the racket.


Citing the Supreme Court's guidelines, the High Court expressed the necessity of transferring the investigation to the CBI to maintain credibility in the justice system and to ensure all involved parties, including the beneficiaries, are held accountable. The decision reflects the court's commitment to uphold the rule of law and protect public interest from systemic exploitation.


The judgment mandates the Additional Director General of Police, CBCID, to transfer all investigation documents to the CBI, with the expectation of a comprehensive and transparent inquiry.
