467 FIRs to be Registered and Transferred to SIT - Court Demands Accountability for Missing Documents in 82 Motor Accident Cases

In a significant development, the Madras High Court has issued critical directives aimed at addressing a colossal financial scam and the disappearance of crucial documents in Motor Accident Claims Tribunal (MCOP) cases. The judgment, pronounced by Justice N. Anand Venkatesh on September 12, 2025, mandates the registration of 467 First Information Reports (FIRs) and their subsequent transfer to a Special Investigation Team (SIT) within a four-week timeframe.


The case, titled "Cholamandalam Ms General Insurance Company Ltd v. Director General Of Police," involves a staggering sum of Rs.105,23,56,770, which is only a fraction of the scam's total magnitude, according to the petitioners. The court has emphasized the urgency of initiating investigations into these complaints to uncover the full extent of the fraud and bring the perpetrators to justice.


During the proceedings, the court scrutinized reports submitted by the Tamil Nadu State Legal Services Authority and the counsel representing the petitioners. The court was informed that numerous cases have been pending in various judicial forums, with some being dismissed for default. The learned Additional Public Prosecutor, representing the respondents, has been granted time to file a comprehensive report on the matter.


In a parallel directive, the court addressed the issue of missing documents in 82 MCOP cases. These documents, crucial for adjudicating compensation claims, have reportedly vanished from court records. Justice Venkatesh has instructed the Principal Sub Judge and the Additional District Judge in Hosur to conduct a thorough inquiry to locate these documents. Should the documents remain untraceable, a criminal complaint is to be lodged to ensure accountability and transparency in the handling of court property.


The court has set October 17, 2025, as the next date for hearing, by which time all concerned parties are expected to submit status reports. This includes updates on the registration and transfer of FIRs to the SIT and the progress of the inquiry into the missing MCOP documents.


The judgment underscores the judiciary's commitment to addressing financial malfeasance and safeguarding judicial processes. It highlights the necessity of swift and decisive action to restore public confidence in the legal system, particularly in cases involving substantial financial implications and potential administrative lapses.
