Court Directs Authorities to Safeguard Fundamental Rights of Petitioner and Take Legal Action If Allegations Are Proved

The petitioner, Revathi, alleged that the conflict arose when she refused to provide a pathway through her land to the adjacent landowner, leading the latter to seek intervention from Katta Panchayat leaders. The Panchayat reportedly issued illegal orders to ostracize Revathi's family, barring them from accessing public amenities like water sources and groceries, and prohibiting their participation in community religious activities.


Revathi's counsel highlighted that these actions were a blatant violation of her fundamental rights under Article 21 of the Indian Constitution. Despite making representations to local authorities, no remedial action was taken, prompting the filing of the writ petition.


The court, recognizing the severity of the allegations, directed respondents, including the District Collector and other relevant authorities, to conduct a thorough and independent inquiry. The court emphasized that if the investigation substantiates the petitioner's claims, legal proceedings, including the filing of an FIR, must be initiated against those responsible.


The judgment reflects the court's commitment to upholding individual rights and ensuring justice is served, reinforcing the constitutional protection against unlawful social exclusion.
