Madras High Court Overturns Single Judge's Order on Promotion Delay Case

Court rules that delay in promotion was not due to departmental fault but employee's own negligence.


In a significant ruling, the Madras High Court's Division Bench, comprising Justices S.M. Subramaniam and C. Kumarappan, overturned a single judge's decision regarding a promotion dispute involving the Government of Tamil Nadu and an employee, M. Rajesh Kumar. The court held that while the right to be considered for promotion is a fundamental right, the delay in acquiring the necessary eligibility was due to the employee's own negligence, rather than any fault of the department.


The case revolved around M. Rajesh Kumar, initially appointed as a Junior Assistant in Thanjavur District in 1994, who later sought promotion to Rural Welfare Officer Grade-I. His contention was that the department delayed his promotion due to administrative lapses. However, the court found that the petitioner had taken excessive leave, amounting to 524 days, which delayed his probation and subsequent eligibility for promotion.


The court emphasized that the department had acted diligently and there was no abnormal delay or mala fide intent in its actions. It noted that the petitioner had only completed the necessary training and service requirements by September 2002, making him eligible for the 2003-2004 promotion panel, which was duly processed.


The court reiterated that while consideration for promotion is a fundamental right, the petitioner could not claim a promotion as a right without meeting the eligibility criteria due to his own lapses. The bench highlighted the lack of any deliberate delay by the department and found no merit in the argument that the department was at fault.


In conclusion, the appeal by the Government of Tamil Nadu was allowed, setting aside the single judge's order which had directed the government to notionally promote Rajesh Kumar with retrospective benefits. This decision underscores the importance of employees fulfilling their eligibility criteria in a timely manner to claim promotions.


Bottom Line:

Promotion is not a fundamental right, but consideration for promotion is a fundamental right. Delay in acquiring eligibility criteria due to employee's own negligence cannot be attributed to the department.
