Court Directs Inquiry into Allegations by All India Lawyers' Association for Justice, Recommends Reposting Before Appropriate Bench


In a significant development, the Madras High Court, under the stewardship of Justice M. Nirmal Kumar, has referred a matter involving serious allegations against legal professionals to the Vigilance Cell for an in-depth inquiry. The case, titled "N. Ganesh Agarwal and Ors. v. Inspector Of Police Anti Corruption Bureau Of Investigation," was initially listed for further hearing and for the submission of citations by the petitioners' counsel. However, proceedings took a new turn following a communication from the Ministry of Law and Justice, which included a representation from the All India Lawyers' Association for Justice (AILAJ) containing specific allegations.


The representation by AILAJ alleged misconduct against certain legal professionals, prompting the court to take immediate steps to address the issue. The court, highlighting the gravity of the allegations, expressed that such matters must be handled with due diligence to uphold the dignity and integrity of the judicial process. Consequently, the court decided not to proceed with the case and instead referred the matter to the Vigilance Cell of the Madras High Court for a thorough inquiry.


Counsel for the petitioners, led by Senior Counsel Mr. M. Murali Kumaran, strongly refuted the allegations, expressing their readiness to cooperate with any inquiry. On the other hand, the Special Public Prosecutor for CBI Cases, Mr. K. Srinivasan, urged the court to take stern steps to identify and penalize the individuals responsible for the allegedly false representation, as such actions could undermine the court's dignity.


Recognizing the potential impact of these allegations on the legal fraternity and the judicial system, the court directed that the matter be placed before the Hon'ble Chief Justice. The Chief Justice is expected to issue appropriate directions for the Vigilance Cell's inquiry and to determine the subsequent course of action, including reposting the case before a suitable bench for further proceedings.
