Court Affirms Plaintiff's Right to Refund and Damages Due to Non-Commencement of Agreed Film Production


In a significant judgment, the Madras High Court has upheld the decision of the lower court, affirming the plaintiff's claim for refund and damages in a breach of contract case involving film production. The court directed the defendants, M/s. R.S. Infotainment (P) Ltd. and others, to pay M/s. Photon Factory a sum of Rs. 4.25 crores with interest at 12% per annum and additional costs, after failing to commence production as per the terms of the agreement dated November 27, 2008.


The dispute arose when M/s. Photon Factory entered into an agreement with the defendants to produce a Tamil movie, advancing Rs. 4.25 crores for the project. Despite the financial commitment, the defendants did not begin production, leading to allegations of breach of contract. Although the defendants claimed that the funds were expended towards production activities, the court found no substantial evidence proving the commencement of the agreed film.


The defendants argued that the plaintiff defaulted on subsequent payments, which stalled the production process. However, the court emphasized that the defendants failed to establish the commencement of the film, and the documentary evidence presented was deemed insufficient and improperly substantiated.


The judgment reiterates the importance of adhering to contractual obligations, emphasizing that the plaintiff is entitled to seek refund and damages under the default clause of the agreement. The court dismissed the defendants' appeal, confirming the lower court's decree and rejecting arguments regarding procedural and limitation challenges.


This judgment underscores the judiciary's role in enforcing contractual commitments and protecting parties from breaches that result in financial loss and damage to reputation.
