Madras High Court Upholds Customs Authority's Classification of 'Assy Guide Rails'

Court Dismisses Appeal by M/s. Inalfa Gabriel Sunroof Systems Pvt. Ltd., Reaffirming Binding Nature of Advance Ruling

 

In a significant ruling, the Madras High Court has upheld the decision of the Customs Authority for Advance Ruling (CAAR) regarding the classification of "Assy Guide Rails" under the Customs Tariff Act, 1975. The court dismissed the appeal filed by M/s. Inalfa Gabriel Sunroof Systems Pvt. Ltd., challenging the classification of the imported goods under Customs Tariff Heading 8708 2900, which pertains to "Other parts and accessories of bodies of motor vehicles."


The appellant had sought an advance ruling, arguing for an alternate classification under various headings, including 8708 9900 and 7610 9020. The Customs Authority had previously determined that the Assy Guide Rails were correctly classifiable under Heading 8708 2900, based on their functional utility and predominant usage in the sunroof systems of vehicles.


Presiding judges Mr. S.M. Subramaniam and C. Saravanan affirmed the binding nature of the advance ruling, emphasizing that such rulings are enforceable unless proven arbitrary, irrational, or contrary to principles of natural justice. The court noted that adequate opportunity for hearing was provided, and no procedural irregularity was found in the impugned order.


The judgment underscores the limited scope of judicial review in customs classification disputes, highlighting that classification should be resolved by appropriate authorities under the Customs Act. The court observed that unless the ruling suffers from illegality, arbitrariness, or procedural lapses, it cannot be interfered with under Section 28KA of the Customs Act, 1962.


The ruling reiterates the importance of certainty and transparency in customs procedures, aligning with the legislative intent to facilitate trade and reduce litigation. This decision is set to guide future classifications and reinforce the binding nature of advance rulings.
