Court affirms the authority of a young Magistrate amidst alleged disruptions by Bar members, reinforcing discipline in judicial proceedings.
In a landmark decision, the Madras High Court's Madurai Bench, presided over by Justice L. Victoria Gowri, has dismissed a series of petitions filed by members of the Bar Association in Madurai, seeking to quash proceedings initiated against them by the Judicial Magistrate No. V, Madurai. The proceedings were triggered by alleged misconduct and interruption during judicial hearings, which the court deemed a significant institutional issue concerning the dignity and authority of the judiciary.
The case arose from an incident on January 20, 2026, involving several advocates and office bearers of the Bar Association who reportedly intervened in remand proceedings, demanding a particular judicial course. The incident was captured on CCTV, forming the basis for the Magistrate's action under Sections 267 and 384 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioners challenged the proceedings, arguing procedural violations and lack of specific allegations, but the High Court found no merit in these claims.
Justice Gowri emphasized the essential partnership between the Bar and the Bench in the justice delivery system, underscoring the need for mutual respect and discipline. She highlighted that any collective attempt by advocates to overbear a Presiding Officer or interrupt court proceedings cannot be condoned as protected professional conduct.
The court's decision also delved into the interpretation of "before the rising of the Court on the same day," affirming that judicial work may extend beyond fixed office hours, thus validating the Magistrate's cognizance taken in such circumstances.
Furthermore, the judgment underscored the role of advocates as officers of the court, bound by professional ethics and responsibilities that transcend mere client representation. The court reiterated that the statutory framework permits summary proceedings for misconduct witnessed in the court's presence, prioritizing the administration of justice over procedural formalities.
Justice Gowri commended the young Magistrate, Ms. Lakshmi Priya, for her resolute adherence to duty amidst considerable pressure, reinforcing institutional integrity and public confidence in the judiciary. The decision is seen as a pivotal affirmation of judicial independence and discipline, setting a precedent for maintaining the sanctity of court proceedings.
Bottom line:-
Advocates must maintain professional ethics and discipline while appearing in court. Collective attempts by Bar members to overbear or interrupt judicial proceedings cannot be condoned.
