Court Overturns Single Judge's Order Allowing Flexibility, Reinforces Bar Council Rules


In a significant judgment, the Madras High Court has reinforced the mandatory attendance requirement for law students, setting aside a single judge's previous directions that allowed for more flexible attendance and examination policies. The Division Bench, comprising Justices S.M. Subramaniam and N. Senthilkumar, ruled on June 17, 2026, that adherence to the Bar Council of India Rules is critical to maintaining the integrity of legal education.


The appeals were filed by the Registrar and Dean of Tamil Nadu Dr. Ambedkar Law University against a prior order that partially allowed students with insufficient attendance to continue their studies and appear for exams. The students had sought leniency due to their attendance shortfall, which was below the mandated 70% threshold, with their attendance percentages recorded at 46%, 41%, and 37% respectively.


The Bar Council of India Rules stipulate a mandatory attendance requirement of 70%, with a possible condonation of 5% under sufficient cause. However, the High Court emphasized that no further relaxation is permissible, as it would undermine the purpose of the rules designed to ensure discipline and engagement in legal education.


The court highlighted the importance of physical classroom learning, noting that it instills discipline, punctuality, and active engagement, which are essential to the legal profession. The judgment underscored that online classes and AI tools such as Chat GPT cannot substitute the ethical lessons and interactive learning environment provided by qualified lecturers in a classroom setting.


Furthermore, the court addressed the principle of equality under Article 14 of the Indian Constitution, affirming that students who meet attendance requirements should not be treated differently from those who do not. This ensures fairness and respects the efforts of students who adhere to the regulations.


The High Court's decision mandates the Tamil Nadu Dr. Ambedkar Law University to adhere strictly to the Bar Council's rules, reinforcing that legal education demands a commitment to discipline and presence in the classroom. The court's order underscores the necessity of maintaining high standards in professional education, ensuring that future legal professionals are well-prepared to serve society.
