In a recent judgment, the Madras High Court, Madurai Bench, upheld the decision of the Judicial Magistrate, Paramakudi, to dismiss a maintenance claim filed by Menaka against her husband, Murugan. The case, presided over by Mrs. L. Victoria Gowri, J., revolved around a maintenance petition under Section 125 of the Criminal Procedure Code, 1973.


Menaka sought a monthly maintenance of Rs. 30,000 from her husband, Murugan, who is a senior citizen suffering from a paralytic attack. The trial court had previously determined that Menaka was capable of sustaining herself, while Murugan, financially constrained due to his medical condition, was unable to provide the requested amount.


The court examined the financial status and needs of both parties. It was noted that Murugan, at the time of his retirement, received retirement benefits and a monthly pension. However, his medical expenses and the need for maintenance under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, were significant factors in the decision.


The court observed that while Section 125 Cr.P.C. aims to prevent destitution, the Maintenance and Welfare of Parents and Senior Citizens Act also mandates the support of senior citizens by their children. The judgment highlighted the necessity of balancing these obligations, particularly when the respondent is financially and physically constrained.


The decision was further influenced by evidence indicating that Menaka had initiated multiple legal proceedings regarding Murugan's assets and retirement benefits, complicating his financial situation. The court emphasized that the trial court's findings, based on substantial evidence, were fair and required no interference.


Ultimately, the High Court dismissed the revision case, underscoring the importance of considering both statutory obligations and the actual financial capacities of the parties involved.
