Supreme Court Raises Maintenance for Wife in Landmark Judgment, Apex Court enhances maintenance from Rs. 15,000 to Rs. 25,000, emphasizing husband's primary obligation


In a significant ruling, the Supreme Court of India has increased the maintenance amount awarded to a wife from Rs. 15,000 to Rs. 25,000 per month, underscoring the husband's primary duty to provide for his spouse. The judgment, delivered by Justices Sanjay Karol and Augustine George Masih, emphasizes that maintenance must be fair and commensurate with the husband's financial capacity and the wife's needs.


The case, Deepa Joshi v. Gaurav Joshi, arose from an appeal by the wife, Deepa Joshi, who challenged the adequacy of the maintenance awarded by the lower courts. The couple, married in May 2023, had their matrimonial life disrupted within a year, leading to Deepa's separation from her husband and lack of independent income.


Initially, the Family Court granted a maintenance of Rs. 8,000, which was later increased to Rs. 15,000 by the Uttarakhand High Court. Dissatisfied with this amount, Deepa approached the Supreme Court, seeking a reassessment of the maintenance quantum.


The Supreme Court, while deliberating on the case, held that deductions for financial commitments like loan repayments should not overshadow the husband's statutory obligation to maintain his wife. The Court highlighted previous rulings, such as Chaturbhuj v. Sita Bai and Rajnesh v. Neha, reinforcing that maintenance should enable the wife to live with dignity, consistent with her status.


The judgment also noted that Gaurav Joshi, employed as a Manager at Canara Bank with a gross monthly income of Rs. 1,15,670, had sufficient means to support the enhanced maintenance. The Court ruled that voluntary financial commitments, particularly those for asset creation, should not diminish the husband's capacity to fulfill his maintenance duty.


The Supreme Court's decision is expected to influence future maintenance disputes, setting a precedent for fair consideration of both parties' circumstances. The order mandates that any arrears be cleared within three months, with the revised maintenance effective immediately.
