Mumbai, Mar 18 A court here on Wednesday granted pre-arrest bail to two executives of a contractor firm and a project consultant in connection with the parapet segment collapse at a Mumbai Metro construction site in Mulund which claimed a life last month.
Fearing arrest in the case, Alpesh Patel (Managing Partner) and Ganesh Gholap (Technical Director) of Milan Road Buildtech LLP, along with project consultant T Sai Suresh Kumar, had sought anticipatory bail, saying they had no direct role in the work on the ground and were falsely implicated in the case.
Additional sessions judge M Oza granted their pleas.
A portion of a concrete parapet collapsed at a Metro construction site in Mulund on February 14, leaving one person dead and three others seriously injured.
Police registered a case for alleged culpable homicide not amounting to murder, mischief causing damage and other relevant offences under the Bharatiya Nyaya Sanhita (BNS).
The anticipatory bail applications of the two executives, filed through advocate Suvarna Vast, claimed that the site supervisor had specifically instructed the welder not to touch the hooks of the un-concretized precast parapet. But the welder ignored these instructions, causing the collapse, and subsequently fled the scene, they claimed.
The company stated that its project director and other senior staff immediately rushed to the spot to assist victims and cooperated with the police investigation.
The police, opposing the applications, alleged that the duo were responsible for ensuring safety measures at the site.
