Supreme Court Enhances Compensation for Amputee with Detailed Guidelines on Prosthetic Limb Costs, In a landmark judgment, the Supreme Court emphasizes the importance of reasonable compensation for prosthetic limbs, ensuring claimants are fully restored to their original position.


In a significant ruling, the Supreme Court of India has enhanced the compensation awarded to Prahlad Sahai, an amputee, by setting comprehensive guidelines for calculating compensation related to prosthetic limbs in motor accident cases. The case, Prahlad Sahai v. Haryana Roadways, saw the apex court address the complexities of awarding just compensation under the Motor Vehicles Act, 1988.


The Supreme Court bench, comprising Justices J.B. Pardiwala and K.V. Viswanathan, overruled both the Motor Accident Claims Tribunal and the Rajasthan High Court, which had previously awarded compensation without considering the cost and maintenance of prosthetic limbs. The court underscored the need for awarding compensation that truly reflects the claimant's needs, considering the life expectancy and replacement cycle of the prosthetic limbs.


In the appeal, the court was asked to determine the adequacy of compensation for the appellant, whose right leg was amputated following a road accident involving a Haryana Roadways bus. The judgment establishes a clear precedent, mandating compensation for seven prosthetic limbs over the claimant's expected lifespan, with a replacement cycle of five years and maintenance costs. The court awarded Rs. 3,00,000 per limb and an additional Rs. 5,00,000 for maintenance until the age of seventy, emphasizing the principle of restitutio in integrum, which aims to restore claimants to their original condition as closely as possible.


The court also addressed the appellant's loss of future income, recognizing his claim of a monthly income of Rs. 6,000 as a heavy vehicle driver, contrary to the lower amount previously assessed. Functional disability was adjudged at 100%, leading to an enhanced compensation of Rs. 16,12,800 for loss of future income. Furthermore, the court awarded Rs. 2,00,000 for litigation expenses.


In its detailed reasoning, the court rejected the government-prescribed rates for prosthetic limbs, noting them as inadequate and affirming the claimant's right to choose suitable alternatives. The judgment also highlighted the necessity of standardizing compensation for prosthetic limbs, urging claimants to furnish price quotations from multiple service providers to assist tribunals in making informed decisions.


This judgment not only provides critical financial relief to the appellant but also sets a crucial legal framework for future cases involving compensation for prosthetic limbs, ensuring that claimants receive fair and adequate restitution.
