In a significant ruling, the Supreme Court of India has upheld the ownership rights of Pawan Garg and others over a contentious land parcel in Green Park Extension Colony, New Delhi. The judgment, delivered by Justices Vikram Nath and Sandeep Mehta, overturns a previous decision by the Delhi High Court's Division Bench, thereby restoring the order of a Single Judge which directed the South Delhi Municipal Corporation (SDMC) to consider incorporating the appellants' plots into the colony's layout plan within 60 days.


The dispute revolves around a 1600 sq. yards plot originally designated for a High School in a 1958 layout plan. This reservation was subsequently de-reserved in 1969 due to insufficient land area, yet the SDMC continued to assert control based on its immovable property register. Previous civil court rulings had already established the appellants' ownership, with injunctions against MCD interference being upheld through multiple judicial levels due to procedural delays by the Corporation.


The Supreme Court criticized the Division Bench for overstepping its jurisdiction by addressing the title issue, which was not in dispute. The Bench had erroneously questioned the ownership despite the finality of civil court decrees favoring the appellants. The Apex Court clarified that a mere register entry does not confer ownership to the municipal body, reaffirming that the land reverted to private ownership post de-reservation and subsequent registered sale deeds.


The judgment has significant implications for land ownership rights against municipal claims, emphasizing due legal process and the sanctity of previous court orders. The SDMC is now tasked with reassessing the incorporation applications without prejudice from earlier observations.
