Compensation on Grounds of Suppressed Prior Marriage Overturned; Recovery of Gold Ornaments and Maintenance Deemed Justified


In a recent judgment, the Kerala High Court delivered a significant ruling in the matrimonial case between K.R. Sandeep and Sreelakshmi, focusing on allegations of suppression of a prior marriage, misappropriation of gold ornaments, and claims for maintenance and compensation.


The case stemmed from Sreelakshmi's claims that her marriage to K.R. Sandeep, solemnized on May 7, 2008, involved the misappropriation of 30 sovereigns of gold ornaments and was entered into without disclosing Sandeep's previous marriage. Sreelakshmi sought recovery of these ornaments, maintenance, and a hefty compensation of Rs. 10 lakhs.


The Family Court initially ruled in favor of Sreelakshmi, granting her a decree for the recovery of 3¼ sovereigns of gold ornaments or Rs. 32,250/- as their market value, along with maintenance of Rs. 1,000/- per month. Additionally, the court awarded her Rs. 5,00,000/- in compensation, citing nondisclosure of the prior marriage.


However, upon appeal, the High Court overturned the compensation decree, emphasizing that there was clear evidence indicating Sreelakshmi was informed of Sandeep’s previous marriage before their union. The judgment highlighted that both the advertisement for marriage proposals and testimonies from the involved parties supported the claim of prior disclosure.


The High Court observed that Sandeep, represented by his father due to his 65% disability, had communicated the details of his past marriage through various interactions, including a meeting at a temple. The court found Sreelakshmi's claims of ignorance unconvincing, especially given her admissions during cross-examination.


Despite setting aside the compensation decree, the High Court upheld the Family Court's decision regarding the recovery of gold ornaments. The oral testimony of Sreelakshmi and admissions from Sandeep’s father substantiated the claim for 3¼ sovereigns, even though the initial claim was for 35½ sovereigns. The maintenance award was also deemed reasonable, reflecting Sandeep’s obligations.


This judgment underscores the importance of evidence in matrimonial disputes and highlights the judiciary's role in balancing claims with factual verifications. While the ruling provided relief to Sandeep regarding the compensation, it maintained Sreelakshmi’s entitlements concerning maintenance and the recovery of gold ornaments, ensuring justice based on the merits of each claim.


The case further illustrates the judiciary's approach to matrimonial cases, where transparency and evidence play pivotal roles in determining outcomes, reinforcing the significance of clear communication and documentation in marital arrangements.
