High Court Invalidates Transfer Decisions Influenced by MPs/MLAs, Reinforces Statutory Guidelines
In a significant ruling, the Orissa High Court, presided over by Justice Dixit Krishna Shripad, has quashed the transfer orders of government school teachers that were influenced by recommendations from Members of Parliament (MPs) and Members of the Legislative Assembly (MLAs). The court held that such political interference constituted extraneous considerations and violated the statutory transfer guidelines. The ruling emphasized the need for adherence to the Right of Children to Free and Compulsory Education Act, 2009, which mandates specific guidelines for the transfer of teachers.
The petitions, filed by a group of teachers, challenged the validity of the transfer orders and a letter dated May 13, 2025, which permitted MPs and MLAs to recommend teacher transfers to jurisdictional authorities. The court noted that the transfer guidelines, issued under sections 19 and 25 of the 2009 Act, possess statutory force and must be strictly followed. Any deviation, including political recommendations, was deemed impermissible.
Justice Shripad highlighted the undesirable nature of political interference in educational matters, stating that it undermines the purity of educational institutions. The court also observed that teachers, although public servants, have a distinct role that necessitates insulation from political influences, especially in transfer matters.
The ruling further addressed the issue of alternate remedies, clarifying that the availability of departmental appeals does not bar the writ jurisdiction when transfer orders are made without jurisdiction or involve extraneous considerations.
The court has directed the continuation of teachers in their original positions until the end of the academic year, ensuring minimal disruption to students. The judgment also mandates the prompt disposal of pending departmental appeals in light of the court's findings.
This verdict reaffirms the importance of maintaining academic sanctity and upholding statutory guidelines in administrative decisions concerning the educational sector.
