The judgment pertains to a revision petition filed by Santosh Patra, challenging the order dated 27.09.2024, which dismissed his execution application on technical grounds. The petitioner, represented by Mr. Budhiram Das, argued that the execution petition should not have been rejected without providing an opportunity to correct deficiencies such as the valuation of government vehicles and immovable properties.
Justice Ananda Chandra Behera, presiding over the case, clarified that the decree-holder should not be denied the fruits of a decree due to technical errors in the execution petition. The court highlighted the autonomy of Order 21 of the Civil Procedure Code, which governs execution proceedings, and reiterated that Section 11 principles of res judicata are inapplicable in such cases.
The High Court's order remits the matter back to the Civil Judge (Sr. Division), Sonepur, directing the court to allow the petitioner to furnish the correct particulars required under Order 21, Rule 11(2) of the CPC. The revision petition was thus allowed, and the parties are instructed to appear before the lower court on 22.10.2025 to continue proceedings in accordance with the High Court's directions.
