In a significant ruling, the Orissa High Court, led by Justice Savitri Ratho, emphasized the importance of timely disposal of applications under the Protection of Women from Domestic Violence Act, 2005. The court addressed the procedural delays and adjournments that often plague these cases, urging judicial officers to avoid unnecessary adjournments to ensure efficient case management.


The case in question, titled Shovan Kumar Sahoo v. Puspanjali Swain, revolved around a petition filed by Shovan Kumar Sahoo, seeking expedited proceedings in a domestic violence case initiated by his wife, Puspanjali Swain. The petitioner argued that despite statutory provisions mandating the disposal of applications within 60 days, the case had been delayed due to repeated adjournments and filing of multiple petitions by the opposite party.


Justice Ratho, acknowledging the practical constraints faced by the judiciary, directed the Judicial Magistrate First Class (J.M.F.C.), Bhubaneswar, to endeavor the disposal of the case within six months, emphasizing the need for effective hearings without unnecessary delays. The court underscored that while adhering to the 60-day timeline might be challenging, efforts must be made to avoid prolonged adjournments that hinder the delivery of justice.


The judgment reiterates the objective of the Domestic Violence Act to provide swift relief and protection to victims, aligning with the constitutional rights granted under Article 15 of the Indian Constitution.
