Suo Motu PIL Leads to Comprehensive Action Plan for Improving Mental Healthcare Infrastructure and Services


In a landmark decision aimed at addressing the pressing issues surrounding mental health care in Bihar, the Patna High Court has initiated a suo motu Public Interest Litigation (PIL) to tackle the inadequacies in the state's mental health facilities. The court's action follows an inspection report submitted by the Bihar State Legal Services Authority (BSLSA) that highlighted severe shortcomings at the Bihar State Institute of Mental Health and Allied Sciences (BIMHAS), Bhojpur.


Presided over by Chief Justice Sangam Kumar Sahoo and Justice Harish Kumar, the bench underscored the critical need for immediate improvements in mental health services in the state. The court emphasized that mental health care is a fundamental right under Article 21 of the Constitution, which guarantees the right to life and dignity.


The report, prepared after an inspection of BIMHAS, revealed that the institution, with its limited inpatient capacity of 180 beds, is grossly inadequate for Bihar's vast population. The court noted the urgent necessity for multiple mental health institutes across the state to address the high prevalence of mental health issues effectively.


The judgment outlined several directives to improve mental healthcare infrastructure, including the expansion of inpatient facilities, establishment of rehabilitation homes, and enhancement of vocational training programs for cured patients. The court also highlighted the need for better coordination between government agencies to facilitate the rehabilitation of patients after treatment.


Furthermore, the court instructed the government to halt sand mining activities near BIMHAS, as the noise and pollution pose significant risks to patients' well-being. It also called for the development of a playground and park within the BIMHAS campus to support therapeutic initiatives.


The judgment mandates various state authorities, including the Health Department and the State Mental Health Authority, to submit detailed reports on the steps being taken to address these issues. The court has scheduled the next hearing for March 16, 2026, where key government officials are expected to provide updates on the progress made.


This proactive stance by the Patna High Court is a significant step towards ensuring that mental healthcare services in Bihar meet national standards, providing accessible, affordable, and high-quality treatment for all residents.
