Bail approved under Bharatiya Nagarik Suraksha Sanhita, 2023, amid lack of objectionable evidence on seized devices.
The Patna High Court has granted bail to Md. Rizvi, also known as Raja, in connection with allegations of involvement in objectionable conduct during a political rally, which allegedly included the dissemination of objectionable content. The order was delivered by Justice Arun Kumar Jha, considering Rizvi's clean antecedent, the period of custody, and the submission of a chargesheet in the case.
The case, registered under Simri P.S. Case No. 243 of 2025, accused the petitioner under various sections of the Bharatiya Nagarik Suraksha Sanhita, 2023, and Section 67 of the IT Act, 2000. The petitioner was implicated after being identified in a viral video by a local chowkidar, though no objectionable material was retrieved from his mobile device.
Despite vehement opposition from the State's counsel, which argued that the petitioner's actions amounted to treason, the court found the lack of direct evidence and the completion of the chargesheet pivotal in its decision to grant bail. The petitioner has been in custody since August 29, 2025.
Justice Jha imposed specific conditions on Rizvi's bail, requiring a bond of Rs. 10,000 with two sureties and compliance with Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Additionally, one bailor must be a close relative, and Rizvi must attend all court dates, with the risk of bail cancellation upon non-compliance.
Bottom Line:
Bail granted considering clean antecedent, period of custody, submission of chargesheet, and nature of allegations with specific conditions imposed under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Statutory provision(s): Bharatiya Nagarik Suraksha Sanhita, 2023 Section 480(3), IT Act, 2000 Section 67
