Court Directs Expedited Roster Clearance and Requisition Processes to Fill Vacant Librarian Positions Across State Universities


In a significant ruling, the Patna High Court has directed urgent measures to address the acute shortage of librarians across universities in Bihar. The division bench, comprising Chief Justice Mr. Sangam Kumar Sahoo and Justice Harish Kumar, emphasized the critical role librarians play in maintaining the academic health and justice within educational institutions. The court observed that the absence of librarians has led to a functional breakdown in library services, severely affecting the academic environment.


The judgment came in response to a public interest litigation filed by Dr. Ranganathan Rajya Pustakalaya Samiti, highlighting the dire state of library services in Bihar's universities due to vacant librarian posts. The court noted that almost all sanctioned librarian positions across various universities remain unfilled, including prominent institutions like Patna University, Magadh University, and B.N. Mandal University, among others.


During the proceedings, Vice-Chancellors from several universities appeared virtually to provide updates on the vacancy status. Most reported that roster clearance processes were underway, with some having already sent requisitions to the Director of Higher Education. However, the court was concerned about the lack of timely action and directed all Vice-Chancellors to expedite roster clearance and subsequent requisition submissions.


The court set a strict timeline for the completion of these processes, mandating that roster clearance be completed within two weeks and requisitions be sent to the Director of Higher Education within an additional two weeks. The Divisional Commissioners were instructed to prioritize roster clearance to facilitate the swift filling of vacancies.


In its order, the court underscored the importance of librarians as custodians of intellectual capital, responsible for ensuring efficient and credible management of research resources. The absence of librarians, the court noted, compromises the academic infrastructure, leading to deterioration of book collections, lack of reference services, and disruptions in journal and database subscriptions.


The court also highlighted that vacancies in librarian posts represent a failure on the part of the state to fulfill its duty to provide necessary educational infrastructure. It reiterated the pivotal role librarians play in distinguishing between search and research, thereby enhancing the academic rigor of university education.


The case has been scheduled for a follow-up hearing on July 6, 2026, to review compliance with the court's directives. The court expressed appreciation for the cooperation extended by the Vice-Chancellors and university officials during the proceedings.
