Court Rules Prosecution Lacked Mandatory Sanction Under Cr.PC for Acts Performed During Official Duty
In a significant ruling, the Patna High Court has quashed criminal proceedings against Anil Kumar Jha, a Range Officer in the Forest Department, citing the absence of mandatory prior sanction required for prosecuting public servants under Section 197 of the Criminal Procedure Code (Cr.PC). The case originated from a complaint filed by Shyam Mandal, an employee of Amapur Construction Limited, who alleged that Jha, along with other accused, intercepted his vehicle transporting stone and Moram, despite possessing valid documents. The complaint accused Jha of abuse, physical assault, and demanding a bribe.
However, the court found that the actions attributed to Jha were performed in the discharge of his official duties as a public servant, thus invoking the protection under Section 197 Cr.PC. The court highlighted that no sanction had been obtained from the competent authority, which is a prerequisite for prosecuting a public servant for acts related to their official duties.
Justice Kumar emphasized the importance of this legal safeguard, designed to protect public servants from frivolous or vexatious litigation that could impede the performance of their duties. The court also noted that the complaint against Jha appeared to be motivated by malice, as it was filed shortly after Jha had initiated legal proceedings against the complainant for illegal mining activities.
In light of these findings, the court quashed the proceedings, including the cognizance and summoning orders previously issued by the Sub-Divisional Judicial Magistrate, Banka.
