In a significant judgment, the Patna High Court has quashed the FIR lodged against Ankit Kumar Sharma and others, residents of Jaipur, Rajasthan, citing it as an abuse of the legal process. The case originated from a complaint filed by Kalawati Devi, who alleged caste-based abuse and assault by the appellants. However, the court found that the complaint was a retaliatory measure against Shalini Sharma, appellant no. 4, who had previously filed a dowry harassment case against her husband, Manish Kumar, and his family in Jaipur. The court noted that the FIR was lodged to harass the appellants and was not substantiated by credible evidence.


Justice Anil Kumar Sinha, presiding over the case, emphasized the importance of safeguarding individuals against misuse of legal provisions. The court relied on CCTV footage and biometric attendance records, establishing the presence of the appellants in Jaipur on the alleged date of occurrence, thereby negating the claims made in the FIR.

The court applied a four-step framework to assess the veracity of the FIR, ultimately concluding that the proceedings were initiated with an ulterior motive.

It also considered the nationwide lockdown during the COVID-19 pandemic, which restricted travel and further questioned the feasibility of the alleged incident.
