Court rules State Government's Pay Verification Cell overstepped its authority, orders refund to petitioner


In a significant ruling, the Patna High Court has set aside the recovery of Rs. 22,08,744 from Pitamber Jha, a retired employee of L.N. Mithila University, Darbhanga, by the State Government's Pay Verification Cell. The judgment, delivered by Justice Ritesh Kumar, emphasized that the Statutory Pay Fixation Committee of the University is the sole authority to fix the pay of university employees, and any post-retirement pay adjustments without due process violate principles of natural justice.


The case arose when Pitamber Jha, who retired as Head Assistant-cum-Accountant on June 30, 2010, was informed that his pay scale had been reduced retroactively by the State Government's Pay Verification Cell. This led to an alleged overpayment recovery notice of over Rs. 22 lakh. Jha contested the move, arguing that the Pay Verification Cell lacked jurisdiction to alter pay fixed by the University's Statutory Pay Fixation Committee and that the recovery without prior notice was unjust.


Justice Kumar, after hearing arguments from both sides, ruled that the relationship of master and servant ceases after retirement, and any alteration of pay scale post-retirement without notice is arbitrary and unsustainable. The court found that the actions of the Pay Verification Cell were without jurisdiction and violated established legal principles, including the judgments of the Supreme Court and previous High Court rulings.


The court ordered the refund of the recovered amount to Jha within three months and reinstated his pay as per the University's original fixation prior to his retirement. This decision reinforces the autonomy of university statutory bodies in pay fixation matters and sets a precedent for similar cases where retired employees face unauthorized recoveries.


Bottom line:-

Pay fixation of university employees must be done by the Statutory Pay Fixation Committee, and the State Government's Pay Verification Cell has no jurisdiction to alter the pay fixed by the university. Recovery of excess payment after retirement without giving notice violates principles of natural justice.
