Plea in SC seeks contempt, NBW against businessman Satinder Bhasin

New Delhi, Apr 21 A plea has been filed in the Supreme Court seeking contempt proceedings and issuance of non-bailable warrants against businessman Satinder Singh Bhasin for not surrendering in connection with the alleged Grand Venice Mall scam despite the apex court's order.


The top court had on April 2 set aside the bail granted to Bhasin, the director of Bhasin Infotech and Infrastructure Private Limited (BIIPL), and directed him to surrender before the jail authorities within a week.


Investors in the upscale projects in Greater Noida had claimed that they were duped by the developer BIIPL.


Alleging "wilful defiance" of the authority of this court, the plea filed by Louleen Kaur Bhalla and Jagvinder Singh, allottees in the projects, sought directions to give effect to and secure compliance with the judgment dated April 2, 2026.


"It is respectfully submitted that, in spite of the clear directions issued by this court in the aforesaid judgment, the petitioner has failed to surrender to date, in disregard and wilful disobedience of the orders passed by this court.


"The petitioner has thus consciously and deliberately chosen not to comply with the said directions, thereby demonstrating wilful defiance of the authority of this court," the plea said.


The petition stated that instead of complying with the judgment, Bhasin has resorted to "dilatory tactics with a view to evade surrender".


The top court had on April 8 refused to entertain Bhasin's plea seeking the extension of time to surrender.


The petition contended that Bhasin has filed another application seeking recall of the judgment dated April 2, 2026, "which is nothing but a calculated attempt to delay and frustrate" the implementation of the directions.


A bench comprising Justices Sanjay Karol and N K Singh on April 2 cancelled Bhasin's bail as he failed to settle the claims of the flat allottees, and also for siphoning off Rs 50 crore from the funds of Bhasin Infotech and Infrastructure Private Limited for his bail bond, despite the court's direction that the said amount should be from his personal account.


"The petitioner has not complied with the conditions of bail imposed upon him vide order dated November 6, 2019. Resultantly, the bail granted to the petitioner is cancelled. The petitioner to surrender within one week from the date of this judgment," the bench said.


The order came on a batch of petitions filed by allottees of the Grand Venice project, seeking cancellation of bail granted to Bhasin due to violations of certain bail conditions.


The top court had directed that Bhasin may apply for regular bail afresh after a period of twelve months, subject to fully complying with the orders passed in the insolvency proceedings.


The top court had, in November 2019, granted Bhasin bail in these cases subject to various conditions.


Around 46 FIRs were registered against several people in connection with the alleged scam in which investors claimed that they were duped by the accused when handing over the plot of land.


The FIRs, registered in New Delhi and Uttar Pradesh, were filed by the allottees of units in the project against the petitioner, alleging non-delivery of their units, siphoning of their funds and impropriety in allotment of land with the collusion of state officials.
