Court Directs Police to Safeguard Life and Liberty of Same-Sex Couple Against Familial Opposition


In a landmark decision, the Punjab and Haryana High Court has reinforced the rights of same-sex couples to live with dignity and security. On May 22, 2026, Justice H.S. Grewal presided over the case of "Anjali v. State of Punjab," where two adult females in a live-in relationship sought protection from their family members, who opposed their union. The court emphasized the enforcement of fundamental rights under Article 226 of the Constitution of India, extending protection to the petitioners without commenting on their relationship status.


The court directed the Senior Superintendent of Police, Patiala, Punjab, to evaluate a previously submitted representation by the petitioners and take necessary steps to secure their life and liberty. This decision aligns with the Supreme Court's guidelines in the 2024 case "Devu G Nair v. State of Kerala," which advocated for the protection of intimate partners from societal stigma and violence.


Counsel for the petitioners, Mr. Rahul Soi, highlighted the couple's plight, noting that their pleas for protection had gone unheard until now. The High Court's directive ensures that their fundamental rights are respected, and necessary measures are taken to protect them from potential threats.
