Miri Piri Institute of Medical Sciences & Research Trust's Properties Deemed "Gurdwara Property" Under 2014 Act


In a significant ruling, the Punjab and Haryana High Court has dismissed a petition filed by the Miri Piri Institute of Medical Sciences & Research Charitable Trust against the Haryana Sikh Gurdwara Management Committee. The Trust sought to challenge a communication from the Committee establishing a Medical Board to oversee the Trust's affairs. The High Court, presided over by Justice Jagmohan Bansal, found that the properties of the Trust, formed under the Shiromani Gurdwara Parbandhak Committee (SGPC), are indeed "Gurdwara Property" as per the Haryana Sikh Gurdwaras (Management) Act, 2014.


The Trust, established by SGPC in 2005 to commemorate the 400th anniversary of the First Parkash of Shri Guru Granth Sahib, was intended to set up a medical college and hospital on land leased from SGPC and various Gurdwaras. The Trust argued that it operated as an independent entity and its properties did not fall under the definition of 'Gurdwara Property.' However, the Court highlighted the pervasive control SGPC retained over the Trust, including appointments and management, which indicated that the Trust's properties were indeed under SGPC's jurisdiction.


Justice Bansal underscored that the Trust's creation was not to establish a separate legal identity but to comply with statutory requirements for setting up a medical college. The Court also referenced the Supreme Court's validation of the 2014 Act, which empowers the Haryana Sikh Gurdwara Management Committee to manage and control Gurdwara properties within Haryana, further solidifying SGPC's control.


This judgment emphasizes the jurisdictional authority of the Haryana Sikh Gurdwara Management Committee over properties linked with SGPC, reinforcing the legal framework established by the 2014 Act. The decision marks a pivotal interpretation of 'Gurdwara Property,' impacting how religious and charitable trusts linked to the SGPC are governed under the Act.
