Punjab and Haryana High Court Enhances Compensation for Deceased Engineering Student

Tribunal's inadequacy rectified; High Court awards Rs. 40,70,000 with interest


In a landmark judgment, the Punjab and Haryana High Court has significantly enhanced the compensation awarded to the family of Rajan Kumar Sharma, a third-year engineering student who tragically died in a motor vehicle accident. The judgment, delivered by Justice Sudeepti Sharma, addresses the inadequacies in the original compensation determined by the Motor Accident Claims Tribunal, Chandigarh.


The Tribunal had initially assessed Rajan’s notional monthly income at Rs. 6,000, resulting in a compensation of Rs. 5,76,000, which was deemed insufficient considering his academic credentials and future earning potential. The High Court revised this figure, recognizing the deceased’s academic standing at Punjab Engineering College, Chandigarh, and his impressive academic record, which pointed towards a promising career trajectory.


Justice Sharma recalibrated the notional monthly income to Rs. 30,000, taking into account the benchmarks set by previous Supreme Court judgments for similarly placed individuals. Additionally, the High Court rectified the Tribunal's oversight by including compensation for future prospects, loss of estate, funeral expenses, and consortium, which the Tribunal had previously neglected.


The revised compensation package includes:

- A monthly income set at Rs. 30,000, with 40% added for future prospects.

- A deduction of 50% for personal expenditure, as per settled law.

- Application of a multiplier of 18 instead of 12, adhering to Supreme Court guidelines.

- Compensation under conventional heads, including Rs. 15,000 for loss of estate, Rs. 15,000 for funeral expenses, and Rs. 80,000 for loss of consortium, encompassing parental and filial consortium.


The total enhanced compensation amounts to Rs. 46,46,000, with a deduction of the original award, resulting in Rs. 40,70,000 as the net enhanced amount. In line with Supreme Court precedents, Justice Sharma also granted 9% per annum interest on the enhanced compensation from the date of the filing of the claim petition until realization.


The respondents have been directed to deposit the enhanced amount with the Tribunal within two months, ensuring prompt disbursement to the claimants.


This judgment underscores the High Court's commitment to ensuring justice and adequate compensation for accident victims, aligning with the Motor Vehicles Act’s objective to provide relief to victims and their families.
