In a significant ruling, the Punjab and Haryana High Court has enhanced the compensation for a motor accident victim, Alam, from Rs. 95,000 to a substantial Rs. 7,72,135. The decision came after Alam, who suffered a 25% permanent disability due to the accident, appealed against the original compensation awarded by the Motor Accident Claims Tribunal, Gurgaon.
The accident, which occurred on November 22, 2005, was attributed to the rash and negligent driving of the vehicle by the respondent. The Tribunal initially awarded a compensation of Rs. 95,000, which Alam deemed grossly inadequate given the extent of his injuries and the resulting permanent disability.
Justice Harkesh Manuja, presiding over the appeal, noted that the original award failed to apply the settled principles of just compensation. The court considered various factors, including loss of income, future earning capacity, medical expenses, pain and suffering, and other pecuniary aspects, leading to the enhanced compensation.
The court found that the appellant was unable to provide documentary evidence of his income as a laborer, but emphasized that the absence of such evidence should not preclude just compensation. Drawing on precedents, the court assessed Alam's monthly income at Rs. 4,000, based on minimum wage notifications and reasonable assumptions about his earnings.
The judgment also revised the interest rate on the compensation from 7.5% to 9% per annum, further increasing to 12% if not paid within three months. This adjustment was made to ensure the compensation remains equitable and just.
The court's decision underscores the importance of adequate compensation for accident victims, taking into account both economic and non-economic factors. The enhanced award aims to provide Alam with a fair compensation reflective of his injuries and the impact on his livelihood.
