Punjab and Haryana High Court Grants Bail in Abetment of Suicide Case

Court cites lack of evidence for direct instigation in Satnam Kaur's case, emphasizes principle of 'bail as a rule'


In a significant ruling, the Punjab and Haryana High Court has granted bail to Satnam Kaur, accused of abetting her husband Kartar Singh's suicide. The judgment was delivered by Justice Manisha Batra, who underscored the lack of evidence for direct or indirect instigation by the accused, which is a crucial requirement under Section 108 of the Bharatiya Nagarik Suraksha Sanhita, 2023.


The case arose from an FIR filed on June 25, 2025, following the discovery of Kartar Singh's body in a canal. The complaint, lodged by Singh's cousin, alleged matrimonial discord and harassment by Kaur, leading to the suicide. However, the court found that mere allegations of harassment without concrete proof of instigation do not meet the legal threshold for abetment.


Justice Batra highlighted the necessity of establishing mens rea, or a guilty mind, and specific intent to abet suicide. The court referenced the Supreme Court's decision in Aranb Manoranjan Goswami v. State of Maharashtra, emphasizing the requirement for clear intent to aid or instigate the suicide.


The court also reiterated the principle that bail is a rule and jail is an exception, noting that prolonged pre-trial detention should not mimic post-conviction punishment. Given the lack of prima facie evidence and the ongoing nature of the trial, the court deemed further incarceration unnecessary and ordered Kaur's release on regular bail.


The prosecution's concerns about potential witness intimidation were noted, but the court maintained that the trial process would not be prejudiced by the bail order. It also left the door open for bail cancellation should Kaur become involved in any subsequent legal issues.
