Punjab and Haryana High Court Grants Bail to Ameen in Treason Case

Accused Released After Six Months in Custody; Court Avoids Commenting on Merits of the Case


In a significant development, the Punjab and Haryana High Court has granted bail to Ameen, who was accused of raising pro-Pakistan slogans during the wartime between India and Pakistan. The decision was made by Justice Rajesh Bhardwaj on November 26, 2025, in response to Ameen's petition for regular bail.


The case, registered under FIR No.184 at Police Station Pinjore, District Panchkula, involved charges under Sections 152 and 197-D of the Bharatiya Nyaya Sanhita, 2023. Ameen was accused of committing an act of treason by allegedly raising the slogan "Pakistan Zindabad." The complaint, filed by Nitish Kumar, led to Ameen's arrest on May 10, 2025.


Despite the gravity of the allegations, the High Court chose not to delve into the merits of the case, emphasizing that such matters would be determined during trial. Ameen's defense argued that the charges were unsubstantiated and politically motivated, referencing previous Supreme Court decisions to challenge the maintainability of the FIR.


The court noted that Ameen had no prior criminal record and had already spent over six months in custody. With the investigation concluded and the charges yet to be framed, the court found sufficient grounds to grant bail.


The state's counsel opposed the bail, citing the seriousness of the allegations and the ongoing legal process. However, the court concluded that the balance of arguments favored Ameen's release on bail.


Ameen's release is contingent on providing bail/surety bonds to the satisfaction of the concerned trial court or Duty Magistrate. The court reiterated that its decision should not be construed as an opinion on the case's merits, which remain to be assessed at trial.
