Punjab and Haryana High Court Grants Interim Bail to Shagandeep Singh for Mother's Last Rites

In a compassionate decision, the Punjab and Haryana High Court has granted interim bail to Shagandeep Singh, allowing him to perform the last rites and cremation of his deceased mother. Justice Rajesh Bhardwaj presided over the case, CRM-2118 of 2026 in CRM-M-73824 of 2025, and issued the judgment on January 19, 2026.


Shagandeep Singh, who is currently facing charges under several sections of the Bharatiya Nyaya Sanhita, 2023, had filed an application seeking interim bail from January 21 to January 31, 2026. His plea was based on the need to conduct the funeral rites of his mother, who passed away on January 10, 2026. The deceased's body has been preserved in the mortuary, awaiting the petitioner’s release for the funeral proceedings.


The petitioner’s counsel, Mr. H.S. Batth, argued that the trial court had previously denied bail due to the absence of a specified cremation date, which was contingent upon Singh's release. Acknowledging the compassionate grounds presented, the court accepted the application for interim bail.


Mr. Raj Karan Singh, representing the State of Punjab, raised no objections to the petitioner's request, facilitating the court's decision to approve the interim bail. The court has mandated Singh to furnish bail/surety bonds to the satisfaction of the concerned Court or Duty Magistrate.


The interim bail is effective from January 20, 2026, allowing Singh time to attend to his familial obligations. He is required to surrender to jail authorities on February 1, 2026, at 10:00 am. The Releasing Officer will ensure that Singh is informed of the surrender date and time upon his release.


This decision underscores the judiciary's recognition of familial duties and the need to balance legal obligations with compassionate considerations.
