Court Slaps Rs. 50,000 Fine on Petitioners for Misusing Judicial Process and Harassing Public Officials


In a significant ruling aimed at curbing the misuse of judicial resources, the Punjab and Haryana High Court, presided over by Justice Sudeepti Sharma, has imposed exemplary costs of Rs. 50,000 on petitioners Virender Singh and others for filing a frivolous contempt petition against Jitender Kumar, an IAS officer. The judgment, dated May 4, 2026, highlights the court's intolerance towards vexatious litigation that clogs the judicial system and unnecessarily harasses public officials performing their duties.


The contempt petition was filed on the grounds of alleged non-compliance with a prior court order dated February 16, 2024, in the case of "Rajbir Singh Kuhar and others Vs. State of Haryana." However, the court noted that the order in question had been set aside by a Division Bench on May 28, 2025, a fact known to the petitioners, who nonetheless chose to proceed with the contempt petition. The court found this to be a clear abuse of the legal process, emphasizing that the respondent had acted in compliance with the court's directives.


Justice Sharma underscored the importance of exercising contempt jurisdiction with caution, only when willful disobedience is clearly evident. The court expressed concern over the rising trend of frivolous litigation, which burdens the judicial system and detracts from genuine cases needing judicial intervention.


Referencing previous judgments, including those from the Supreme Court, the court reiterated the need to deter such litigation by imposing costs. In similar past cases, such as "Payal Chaudhary v. KAP Sinha IAS," the court had emphasized the detrimental impact of vexatious proceedings on judicial efficiency and integrity.


In a strong message to deter future misuse of the judicial forum, the court ordered the petitioners to pay Rs. 50,000 to the respondent. The amount is to be deposited in the respondent's bank account, failing which it would be recovered as arrears of land revenue. This decision reaffirms the judiciary's commitment to maintaining the sanctity of its proceedings and discouraging litigants from engaging in baseless legal battles.
