Court Imposes Penalties for Delays, Directs Authorities to Expedite Possession of Secured Assets


In a significant judgment, the Punjab and Haryana High Court has directed the swift enforcement of orders under Section 14 of the SARFAESI Act, 2002, emphasizing the administrative role of the District Magistrate in ensuring timely possession of secured assets. The division bench, comprising Justices Suvir Sehgal and Deepak Manchanda, passed the order in the case of IIFL Home Finance Ltd. versus State of Haryana, highlighting the prolonged delays in executing possession orders as contrary to the statutory mandate.


The court sternly criticized the inaction of the State authorities, underscoring that delays in executing orders not only undermine the statutory purpose of the SARFAESI Act but also amount to contempt of court. To address this, the court imposed a penalty of Rs. 50,000 each on the State of Haryana and the State of Punjab, directing that the amount be deposited with the Institute for Blind, Chandigarh, within a month.


The judgment reiterated the need for strict adherence to guidelines previously laid down, mandating that District Magistrates must act within a maximum period of 60 days from the order date to facilitate the taking of physical possession. The court also emphasized that non-compliance would be treated as contempt.


This decision follows a series of similar judgments where the court had previously directed the States to ensure effective implementation of Section 14 of the SARFAESI Act, emphasizing the doctrine of 'stare decisis' and the need for legal certainty and predictability. The court's directive serves as a strong reminder to State authorities to adhere to statutory obligations and judicial precedents to avoid unnecessary litigation and ensure the expeditious recovery of non-performing assets.
