Court Slams Misuse of Judicial Process, Imposes Rs. 3 Lakh Costs on Petitioner for Vexatious Litigation


In a significant ruling, the Punjab and Haryana High Court has imposed exemplary costs of Rs. 3 lakh on petitioner Rajbir Singh Brar for filing a frivolous contempt petition against Gaurav Yadav and others. The judgment, delivered by Justice Sudeepti Sharma, highlights the gross misuse of judicial processes through vexatious litigation, which clogs the judicial system and harasses public officials.


The petitioner, who represented himself, had filed the contempt petition alleging deliberate and intentional disobedience of a previous court order dated July 30, 2024. This order, passed by the Division Bench of the High Court, directed the State of Punjab to register FIRs for cognizable offences and adhere to the Pre-Conception and Pre-Natal Diagnostic Techniques Act, 1994.


During the proceedings, the court noted that the petitioner had a history of filing similar petitions without merit, thereby abusing the legal process. The court observed that despite compliance by the respondents, the petitioner continued to file baseless allegations, wasting valuable judicial time and resources.


Justice Sharma emphasized that the contempt jurisdiction must be exercised with caution and only in clear cases of willful disobedience of court orders. The ruling drew on precedents from the Supreme Court, which have consistently discouraged frivolous litigation by imposing costs to deter misuse of the judicial system.


The court found no evidence of disobedience by the respondents, who had filed detailed affidavits and reports demonstrating their compliance with the court's directions. The judgment underscored the need to curb frivolous litigation to preserve the sanctity of judicial proceedings and ensure that judicial time is devoted to bona fide grievances.


In line with this, the court ordered the petitioner to pay Rs. 3 lakh as costs, to be disbursed equally among the respondents. The decision is a stern reminder to litigants of the consequences of engaging in vexatious legal actions and serves as a deterrent against the misuse of legal forums.
