The case arose when the Central Administrative Tribunal quashed the appointment of Deepak Kumar Nishad to the post of Supervisor, which was originally made following an advertisement in 2013. This decision prompted the High Court to direct the Chandigarh Administration to revisit and potentially revise its service recruitment rules to ensure that existing employees are not disadvantaged in favor of candidates brought in through deputation or transfer.
The Court emphasized that promoting existing employees should be the priority. It instructed the Chandigarh Administration to consider Nishad for promotion to the post of Manager, provided he meets the eligibility criteria. If Nishad is promoted, the resultant vacancy for the Supervisor position should then be filled by Arun Kumar, as per the regulatory framework.
The court's decision aims to uphold the interests of internal employees by ensuring that promotional opportunities are not overshadowed by external appointments. The judgment also mandates the Chandigarh Administration to revisit its recruitment rules to prevent the sidelining of its own employees in favor of deputation or transfer candidates unless no suitable candidates are available for direct promotion.
Moreover, the judgment allows for pending benefits, previously withheld due to ongoing proceedings, to be claimed by making a representation to the relevant authorities. The Court has set an eight-week deadline for the authorities to address these representations.
