Punjab and Haryana High Court Upholds Denial of Maintenance Claim by Senior Citizen

Court Finds No Grounds for Interference as Senior Citizen Found Financially Self-Sufficient and Claim Primarily Property-Related


In a recent judgment, the Punjab and Haryana High Court upheld the decisions of lower authorities, rejecting the maintenance and property transfer cancellation claims of a senior citizen under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The case, Jeet Singh v. State of Punjab, revolved around a senior citizen, Jeet Singh, who alleged neglect by his sons from his first marriage after transferring property to them. Singh sought maintenance of Rs. 30,000 per month and cancellation of the property transfer deed.


The Court, after reviewing the facts and evidence, found that Jeet Singh was living comfortably with his second wife and son from his second marriage, and had sufficient resources through various businesses, including a fish farming business and solar system enterprise. The dispute was primarily property-related, with Singh attempting to reclaim property transferred to his sons from the first marriage. 


The initial petition was dismissed by the authorities under the Act on September 17, 2024, and the decision was upheld by the Appellate Tribunal on February 19, 2025. Further, the writ petition filed under Article 226 of the Constitution of India was also dismissed by a Single Judge on May 28, 2025. The Court found no perversity or infirmity in the findings of the lower authorities, concluding that Singh's claims lacked merit.


Senior Advocate Rohit Kapoor, who presided over the case, noted that the senior citizen’s self-sufficiency was evident and the familial nature of the dispute did not warrant interference from the Court. The Court emphasized that the appellant had not been able to substantiate claims of neglect or financial incapacity, thereby justifying the dismissal of the appeal.
