Punjab and Haryana High Court Upholds Full Family Pension for Sole Surviving Widow

Court rejects application of apportionment rules, grants full pension rights to Manjit Kaur


In a significant judgment reinforcing the rights of surviving spouses, the Punjab and Haryana High Court has ruled in favor of Manjit Kaur, granting her the right to receive 100% of the family pension following the death of her husband, Parshotam Lal Puri. The court quashed a memo from the Accountant General that restricted her to only 50% of the pension, citing misinterpretation of the Punjab Civil Services Rules.


Presided over by Justice Namit Kumar, the case revolved around the interpretation of Rule 6.17(4) of the Punjab Civil Services Rules, Volume II, and its associated notes. Manjit Kaur, the sole surviving widow of Mr. Puri, had been denied full pension benefits on the basis of these rules, which are typically applied in cases involving multiple eligible claimants.


The court determined that neither Note 1 nor Note 2 under the rule applied to Kaur's situation, as she was the only surviving widow, and there were no minor children from Mr. Puri's first marriage, which had ended with the demise of his first wife in 1980. The court cited previous rulings, including a Division Bench judgment in the case of Harpal Kaur, to support its decision.


Justice Kumar's judgment emphasized that the family pension is meant as an estate for the legal heirs of a deceased employee and should be distributed in accordance with applicable laws rather than being retained by the state under administrative pretexts.


Directing the respondents, including the State of Punjab and the Accountant General, to rectify the situation, the court ordered the payment of full pension benefits to Manjit Kaur, effective from the date of her husband's death, along with arrears and interest at 6% per annum.


This judgment underscores the judiciary's role in safeguarding the rights of individuals against administrative misinterpretations, ensuring that legal provisions fulfill their intended purpose of providing for the families of deceased employees.


Bottom line:-

Family Pension - A widow is entitled to full family pension when she is the sole surviving eligible heir of the deceased government employee, and there are no minor children from the deceased's earlier marriage.
