In a significant judgment, the Punjab and Haryana High Court has dismissed the appeal filed by National Insurance Company Limited, affirming the decision of the Motor Accident Claims Tribunal, Jind. The court upheld the statutory provision that a driving licence remains valid for 30 days beyond its expiry, thus denying the insurer's claim for recovery rights.


The case, titled "National Insurance Company Limited v. Satbir," revolved around an accident that occurred on July 4, 2001. The driver involved, whose licence had expired on June 4, 2001, was alleged to be unlicensed by the insurer at the time of the accident. However, the court ruled that under Section 14 of the Motor Vehicles Act, 1988, the licence remained effective during the statutory grace period, which included the date of the accident.


Justice Virinder Aggarwal, delivering the judgment, emphasized the clear legislative intent to extend the effectiveness of a driving licence for 30 days post-expiry. The court referenced previous judgments, including those by the Allahabad High Court and its own precedent in "State of Haryana v. Karkor," to reinforce that insurers cannot claim breach of policy conditions if the accident occurs within this grace period.


The court's decision highlights the importance of understanding statutory provisions and their implications on insurance claims. By affirming the Tribunal's decision, the court has provided clarity on the legal standing of expired driving licences within the grace period, ensuring that policyholders are not unjustly penalized for technicalities.
