Marriage and Child Birth Lead to Re-examination of Key Witnesses in Criminal Case


In a significant development, the Rajasthan High Court, Jaipur Bench, presided over by Justice Anoop Kumar Dhand, has allowed the recalling of witnesses in a case involving serious criminal charges against Shankar, the petitioner. The decision was made under the purview of Section 311 of the Criminal Procedure Code, 1973, which empowers courts to recall witnesses to ensure justice is served.


The case in question involves accusations under Sections 376, 363, and 366 of the Indian Penal Code, along with charges under the Protection of Children from Sexual Offences (POCSO) Act. During the trial, the prosecutrix, identified as PW-1 'G', and her mother, PW-2 'M', had already provided their statements. However, subsequent to their depositions, Shankar married the prosecutrix, and the couple had a child, changing the dynamics of the case significantly.


The trial court initially rejected the application to recall the witnesses, citing opposition from the Public Prosecutor. However, the High Court overturned this decision, emphasizing the need to protect the matrimonial life and the welfare of the child born from the wedlock. The court observed that recalling the witnesses under the changed circumstances would not prejudice the prosecution or any other party involved.


In its order, the High Court reiterated the essence of Section 311, highlighting its role in discovering truth and rendering a just decision. The court emphasized that this power must be used judiciously and not arbitrarily, ensuring it does not serve to fill gaps in prosecution or defense cases or cause undue prejudice to any party.

The court noted its role as a guardian of matrimonial institutions, especially when children are involved.


The judgment mandates the trial court to summon the prosecutrix and her mother once more, allowing their evidence to be recorded afresh.
