Rajasthan High Court Denies Bail in High-Profile Cyber Crime Case

Court Emphasizes Need for Robust Mechanisms to Tackle Growing Cyber Crime Threats

In a significant ruling, the Rajasthan High Court has denied bail to Adnan Haidar Bhai and Rahul Jagdish Bhai Jadhav, accused in a high-profile cyber crime case involving the extortion of Rs. 2.02 crores from elderly victims through impersonation and digital arrest techniques. The court, presided over by Justice Ravi Chirania, underscored the severity of the offenses under the Bharatiya Nagarik Suraksha Sanhita, 2023, highlighting the need for a comprehensive response to the growing threat of cyber crimes.

The petitioners, who were arrested in connection with FIR No. 3/2025 at the Cyber Police Station in Jodhpur, had their bail applications rejected by the trial court earlier. Despite arguments from their defense claiming innocence and lack of involvement in the alleged crimes, the court found the nature of the offenses too serious to warrant bail at this stage.

Justice Chirania pointed to the evolving nature of cyber crimes and the challenges faced by law enforcement due to technological advancements and the lack of adequate resources. The court issued a series of directives aimed at enhancing the state's ability to combat such crimes, including the establishment of the Rajasthan Cyber Crime Control Centre (R4C), recruitment of IT-qualified inspectors, and stricter regulation of digital transactions and devices.

The court's ruling also addressed broader systemic issues, calling for improved coordination between state and central agencies, banks, and financial institutions to detect and prevent cyber fraud. The decision highlighted the need for technological competence among police officials to handle cyber crime cases effectively and emphasized creating public awareness to safeguard vulnerable individuals from becoming victims.

The case has drawn attention to the rapid digital transformation in India, which, while facilitating growth and connectivity, has also exposed individuals and institutions to increased risks of cyber attacks. The court's directives aim to bolster the state's defenses against such threats, ensuring that law enforcement agencies are equipped to address the complexities of cyber crimes in the digital age.

Bottom Line:

Cyber crimes have become a significant challenge due to the rapid evolution of digital technology and the lack of adequate resources, technical expertise, and infrastructure within the police force and investigating agencies - The court issued comprehensive directions to the State of Rajasthan to establish a robust mechanism for the prevention, detection, and investigation of cyber crimes, including the establishment of Rajasthan Cyber Crime Control Centre (R4C), recruitment of IT-qualified inspectors, and regulation of digital transactions and devices.
