Court Emphasizes Dignified Living for Senior Citizens Under Maintenance and Welfare Act


Jaipur, January 29, 2026: In a significant move aimed at enhancing the welfare of senior citizens, the Rajasthan High Court has issued directives for a comprehensive review of old age homes across the state. The Division Bench, comprising Dr. Pushpendra Singh Bhati and Sangeeta Sharma, JJs, pronounced the order in the case of Lok Utthan Sansthan v. State of Rajasthan, emphasizing the constitutional and statutory mandate for the establishment of old age homes with adequate facilities.


The court highlighted the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, which mandates the establishment of old age homes in every district for indigent senior citizens. The judgment underscored that the real purpose of such homes is not only their existence but ensuring they are equipped with essential amenities, medical facilities, and welfare support, thus guaranteeing safety, dignity, and care for the elderly.


Reflecting on the constitutional commitment to senior citizens' welfare, the court referenced Articles 21, 41, 46, and 47 of the Indian Constitution, which collectively provide the foundation for policies ensuring the dignity, care, and security of senior citizens. The judgment also reiterated the necessity of periodic monitoring of old age homes, as emphasized by the Supreme Court in previous judgments, to ensure adequate infrastructure and medical care.


The court acknowledged the current operation of 31 old age homes in Rajasthan but insisted on a detailed understanding of the facilities and measures available. It directed the Rajasthan State Legal Services Authority to conduct an assessment and file a report by February 15, 2026. The report should cover aspects such as the construction of homes, the residency of elderly persons, availability of medical facilities, government aid, and any other relevant welfare issues.


This directive is part of a broader effort to ensure the legislative intent of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, is fully realized. It aligns with the global and national focus on safeguarding the rights and well-being of older persons, emphasizing the importance of creating an age-friendly environment and improving access to healthcare.
